This document contains the Terms and Conditions governing your use of this website and the contract between the two of us; you and us. These Conditions establish the rights and obligations of all users and those of FEMTECHNOLOGY, S.L. (hereinafter “Skinvity”) in relation to the products and services offered through this website. Please read these Terms and Conditions carefully before using this website or placing an order through this website. You are aware that you are bound by these Conditions, so if you do not agree to all of the Conditions, you must not place an order.
These Conditions are subject to change, so please read them before placing each order.

1. ORDERING MODALITIES, PRICE AND PRODUCT INFORMATION
Users have the possibility to place all their orders from the website www.skinvity.com.
Each Skinvity user declares that he or she has full capacity to use credit cards and that the same have sufficient funds to cover all costs resulting from the purchase of products through Skinvity.
By clicking on the “Pay by card” or “Place order” button during the purchase process, the user declares that he/she fully and unreservedly accepts all of these General Terms and Conditions of Sale.
The data recorded by Skinvity constitutes proof of the transactions made between Skinvity and its customers. Skinvity will confirm your order by sending you an e-mail.
The contractual information is presented in English and will be confirmed at the latest at the time of delivery.
The prices of our products include all taxes, but do not include transport costs, which will be paid by Skinvity for orders over 50€. At Skinvity there is no minimum purchase amount.
The welcome discount voucher can be used on orders over 99€.
Skinvity reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of the registration of the orders (subject to the availability of the product).
By making a purchase at Skinvity, the user or customer declares to have read and understood all the information relating to the products purchased. This information can be found on each product page, and includes a general description of the product’s operation or characteristics, as well as technical details on how to use it correctly.
2. AVAILABILITY
Skinvity hará todo lo posible por satisfacer la demanda de productos de todos sus clientes.
In case of unavailability of the product after the order has been placed, the member will be informed by e-mail of the cancellation of the order.
As a result of this demand, the speed of the refund to the customer’s bank account will depend on the type of bank card and the conditions of each bank. These deadlines are again specified in the “Delivery” clause.
3. PAYMENT
Purchases can be made by bank card (credit and debit card, VISA or MasterCard) through the Redsys Point of Sale Terminal (POS).
In the event that the POS informs the customer that the card has been refused, the order will be automatically cancelled and the customer will be informed online of the cancellation.

4. SECURITY
Skinvity is based on the WordPress e-commerce platform (http://www.ionos.es/). WordPress ensures payment security by being PCI Compliant Level 1.
Both Redsys and WordPress are PCI Compliant Level 1.
This means that the bank details entered are encrypted and securely transmitted to the payment gateway servers and then verified with the issuing bank to prevent fraud and abuse.
This data entry procedure is guaranteed by 256-bit SSL (Secure Sockets Layer) encryption technology, one of the most advanced and effective protection systems currently available, thanks to which no third party will have access via the Internet to this information relating to the banking data entered by the customer.
Only WordPress and the aforementioned payment gateway have access to the bank details linked to these payment methods, Skinvity does not have access to them at any time.
5. DELIVERY
The supplier will send the products to the distribution warehouse, from where the products will be shipped to the final destination at the address set by the buyer. Each time an order is to be shipped, the buyer will receive an e-mail informing him that his goods have left the warehouse.
Transport costs shall be borne by the purchaser unless otherwise stated.
The products bought in Skinvity will be sent to Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla.
Delivery can be made throughout the day, Monday to Friday, from 8am to 8pm. Standard delivery times will be between 7 and 10 days.
The estimated delivery times announced on the website may be subject to alterations due to causes beyond Skinvity’s control, and are in no case binding or guaranteed dates.
The purchase order corresponding to the order will be available in Skinvity, once the payment has been confirmed, which can be viewed via the link: “My Orders”, as soon as the e-mail has been sent. This original purchase order includes delivery costs and VAT.
Skinvity will ask its clients to choose the place of delivery, having to specify their domicile, office or centre where they want the product to be delivered, where they will receive it in a term that will depend on the availability of the product, as well as of the transport agency.
Skinvity will inform the customer of the departure of the order from the distribution warehouse by sending an e-mail.
Each delivery is considered to have been made as soon as the product is made available to the customer by the carrier, as evidenced by the control system used by the carrier. It is up to the addressee to check the order at the time of delivery and to make any reservations and complaints that may appear justified, including the possibility of rejecting the package if it has been opened or if there are obvious signs of deterioration.
Reservations and complaints must be addressed to Skinvity by e-mail to the address to be found on the Skinvity website.
6. RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within 15 calendar days without giving any reason.
The withdrawal period shall expire 15 calendar days after the day on which you or a third party, other than the carrier and indicated by you, acquired the material possession of the last of these goods. To exercise your right of withdrawal, you must notify us of your decision to withdraw from the contract via our contact form. You may use the model withdrawal form below, although its use is not compulsory.
In order to comply with the withdrawal period, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.
Consequences of withdrawal
In the event of withdrawal by you, we will refund to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of standard delivery offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any charges as a result of the reimbursement. We may withhold reimbursement until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first.
You must return or deliver the goods directly to us at the address provided by us within mainland Spain, without undue delay and in any event not later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before the deadline has expired. You will have to bear the direct cost of returning the goods.
You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal for certain goods
In accordance with the legal regulations in force, the right of withdrawal shall not apply to contracts relating to:
(a) The supply of goods that are likely to deteriorate or expire rapidly.
(b) the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.
7. GUARANTEE
The guarantees and after-sales services will be governed by the Royal Legislative Decree 1/2007 of 16 November which approves the text of the General Law for the Defence of Consumers and Users. Before making any return you must contact Skinvity via email info@skinvity.com indicating your order number. In the event that an item does not work properly or is defective, it may be exchanged for another item of the same or equivalent quality.
The warranty period of the products will depend on each device. Some brands have a direct guarantee on their products, in which case the customer will be provided with the means of contact to be able to exercise this guarantee within the time limits offered.
Defects caused by negligence, knocks, improper use or handling, unsuitable voltage, incorrect installation, or materials subject to wear and tear through normal use are not covered by the guarantee. Defects due to failure to follow the instructions indicated on the website of each product or in the basic operating instructions included with the product at the time of delivery are also not included in the warranty.
The consumer must inform Skinvity within two months of becoming aware of the non-conformity of the product and the consumer shall be liable for any damage or loss actually caused by the delay in communication.
8. LIABILITY, LITIGATION AND APPLICABLE LAW
The client or purchaser assumes knowledge of the data and characteristics of the products purchased, and agrees with the information provided by Skinvity. The client declares that:
-He/she is a person of legal age in accordance with the legislation in force.
-You are authorised to use the account, card or payment method provided to make the purchase.
-You confirm that you are aware of and consent to receiving the product at the place and in the conditions informed during the purchase process.
-The data reported during the process is correct and completely truthful, and that he/she is aware of the information on the products.

Skinvity cannot be held liable for non-performance of the contract concluded in cases of force majeure, total or partial disruption or strike, in particular of postal services and means of transport and/or communications, flood or fire. In the event of a dispute, the member shall give priority to Skinvity in order to reach an amicable solution.
These General Terms and Conditions are governed by Spanish law. The parties submit, at their choice, to the courts and tribunals of the user’s domicile for the resolution of conflicts, renouncing any other jurisdiction.
9. MODIFICATION OF THE GENERAL CONDITIONS OF SALE
Skinvity reserves the right to modify the general conditions of sale without prior notice, being able to change, delete or add both the contents and services provided through the same and the way in which these appear presented or located on its servers.
These changes must be accepted by the User each time he/she makes a purchase through the Skinvity website.
Skinvity members who do not agree with the changes to the general terms and conditions must notify Skinvity and, from the date on which the new version comes into force, must cease to use the Skinvity services. In the event of any of the terms of the general conditions being illegal or unenforceable, it will be null and void and the terms agreed by the parties will be applied, failing which the Spanish Civil Code will be applied.
10. ELECTRONIC NOTIFICATIONS
Skinvity will be able to contact users at all times through all available channels, according to the information provided by the user, such as e-mail, telephone, among others.
