This document contains the Terms that govern the use of this website and the contract that binds the two of us: you and us. These Terms set out the rights and obligations of all users and of FEMTECHNOLOGY, S.L. (hereinafter, “Skinvity”) in relation to the products and services offered through this website. Please read these Terms carefully before using this website or placing an order through it. You acknowledge that you are bound by these Terms and, therefore, if you do not agree with all of them, you must not place any order.

These Terms may be amended, so you should read them before placing each order.

1.ORDER METHODS, PRICING, AND PRODUCT INFORMATION 

Users may place all orders from www.skinvity.com

Each Skinvity user represents that they have full capacity to use credit cards and that such cards have sufficient funds to cover all costs resulting from the purchase of products through Skinvity.

By clicking the “Pay by card” or “Place order” button during the checkout process, the user declares that they fully and unreservedly accept these General Terms of Sale.

The data recorded by Skinvity constitute proof of the transactions made between Skinvity and its customers. Skinvity will confirm your order by sending an email.

Contract information is provided in Spanish and will be confirmed at the latest at the time of delivery.

All taxes are included in our product prices, but shipping costs are not included and will be covered by Skinvity for orders over €50. Skinvity has no minimum purchase amount.

The welcome discount coupon may be used on orders over €99.

Skinvity reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the order is registered (subject to product availability).

By making a purchase on Skinvity, the user or customer declares that they have read and understood all information related to the products purchased. This information is available on each product page and includes everything from a general description of operation or features to technical usage details for proper operation.

2. AVAILABILITY

Skinvity will make every effort to meet all customer demand for products.

If a product is unavailable after an order has been placed, the member will be informed by email of its cancellation.

Following such a request, the speed of the refund to the customer’s bank account will depend on the type of bank card and the conditions of each bank. These timeframes are further specified in the “Delivery” clause.

3. PAYMENT

Purchases can be made by bank card (credit and debit, VISA or MasterCard) through the Redsys Point-of-Sale Terminal (TPV).

If the TPV reports that the card has been declined, the order will be automatically canceled and the customer will be informed of this cancellation online.

4. SECURITY

Skinvity is based on the WordPress e-commerce platform (http://www.ionos.es/). WordPress ensures payment security as PCI Level 1 Compliant.

Both Redsys and WordPress are PCI Level 1 Compliant.

This means that the banking data entered are encrypted and securely transmitted to the payment gateways’ servers and are subsequently verified with the issuing bank to prevent possible fraud and abuse.

This data entry procedure is guaranteed by 256-bit SSL (Secure Sockets Layer) encryption technology, one of the most advanced and effective protection systems currently available, thanks to which no third party will have Internet access to this banking data entered by the customer.

Only WordPress and the aforementioned payment gateway have access to the banking data linked to these payment methods; Skinvity never has access to them.

5. DELIVERY

The supplier will send the products to the distribution warehouse, from which the products will be dispatched to the final destination indicated by the buyer. Each time an order is to be shipped, the buyer will receive an email informing them that the goods have left the warehouse.

Shipping costs will be borne by the buyer unless otherwise indicated.

Products purchased on Skinvity will be shipped to mainland Spain, the Balearic Islands, and the Canary Islands.

Delivery can take place at any time of day, Monday to Friday, from 8:00 to 20:00. Standard delivery times are 7 to 10 days.

Estimated delivery times stated on the website may be affected by causes beyond Skinvity’s control and are not binding or guaranteed.

The purchase order corresponding to the order will be available on Skinvity once payment is confirmed, and can be viewed via the link “My Orders” from the time the email is issued. This original purchase order includes delivery costs and VAT.

Skinvity will ask its customers to choose the place of delivery, specifying their home, office, or center where they want the product delivered, where it will be received within a timeframe that depends on product availability and the transport agency.

Skinvity will inform the customer of the order’s departure from the distribution warehouse by email.

Each delivery is considered completed once the product is made available to the customer by the carrier, as recorded by the carrier’s control system. It is the recipient’s responsibility to check the order at the time of delivery and to make any reservations and claims that appear justified; the recipient may even refuse the package if it has been opened or shows clear signs of damage.

Reservations and claims must be addressed to Skinvity by email at the address found on the Skinvity website.

6. RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within 15 calendar days without giving any reason.

The withdrawal period will expire 15 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquires physical possession of the last of those goods. To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through our contact form. You may use the model withdrawal form set out below, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of this right before the withdrawal period has expired.

Effects of withdrawal

In the event of your withdrawal, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 calendar days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back or deliver the goods directly to the address we provide within mainland Spain, without undue delay and in any event not later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract. The deadline is met if you send back the goods before the period of 14 calendar days has expired. You shall bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion of the right of withdrawal for certain goods

In accordance with applicable law, the right of withdrawal shall not apply to contracts relating to:

a) The supply of goods which are liable to deteriorate or expire rapidly.

b) The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.

7. WARRANTY

Warranties and after-sales services are governed by Royal Legislative Decree 1/2007 of 16 November, which approves the consolidated text of the General Law for the Defence of Consumers and Users. Before making any return, you must contact Skinvity by email at info@skinvity.com
, indicating your order number. If any item does not work properly or shows a defect, it may be exchanged for the same or an equivalent item.

The warranty period for products will depend on each device. Some brands offer a direct warranty on their products; in such cases, we will provide the customer with the contact method to exercise that warranty within the periods offered.

The warranty does not cover defects caused by negligence, knocks, improper use or handling, unsuitable voltage, incorrect installation, or materials subject to wear due to normal use. The warranty also does not cover defects arising from not following the instructions indicated on each product’s web page or in the basic operating instructions included with the product at delivery.

The consumer must inform Skinvity within two months from becoming aware of the product’s lack of conformity, and the consumer will be liable for any damages actually caused by delay in such communication.

8. LIABILITY, DISPUTES, AND APPLICABLE LAW

The customer or buyer acknowledges awareness of the data and characteristics of the products purchased and agrees with the information provided by Skinvity. The customer declares that:

They are of legal age in accordance with applicable law.

They are authorized to use the account, card, or payment method provided to make the purchase.

They acknowledge and consent to receive the product at the place and under the conditions informed during the purchase process.

The data provided during the process are correct and entirely truthful, and they are aware of the product information.

Skinvity shall not be liable for failure to perform the contract in cases of force majeure, disruption, or total or partial strike—particularly of postal services and means of transport and/or communications—flood, or fire. In the event of a dispute, the member shall first contact Skinvity to seek an amicable solution.

These General Terms are governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user’s domicile.

9. AMENDMENT OF THE GENERAL TERMS OF SALE

Skinvity reserves the right to amend the general terms of sale without prior notice, and may change, remove, or add both the content and services provided through the website and the manner in which they are presented or located on its servers.

These changes must be accepted by the User each time a purchase is made through the Skinvity website.

Skinvity members who do not agree with the amendment of the general terms must notify us and, from the date on which the new version enters into force, must stop using Skinvity’s services. If any of the terms of the general conditions are illegal or unenforceable, it shall be null and void, and the parties’ agreement shall apply and, failing that, the provisions of the Spanish Civil Code.

Skinvity may contact users at any time through all available channels, according to the information provided by the user, such as email, telephone, among others.
